Cupertino has filed another motion in a bid to get several Samsung devices banned in the U.S.
Apple and Samsung have been fighting it out in court for quite some time now.*The first trial in this case took place back in 2011 when Apple requested that the court hand down an injunction banning Samsung from selling Galaxy smartphones in the U.S. because they infringed on three of its patents. The request was denied because Judge Lucy Koh ruled that there was no evidence that irreparable harm would be inflicted on Apple if Samsung continued to sell its devices.
Nevertheless, Apple had its day in the U.S. Court of Appeals for the Federal Circuit, which ruled that Judge Koh must reconsider her ruling on not banning Samsung devices found to infringed on Apple’s patents. Which is why Cupertino has filed another motion to have the ban put in place, it wants the court to schedule a separate injunction trial on January 30, 2014. The company says that products named in the 2011 lawsuits are no longer commercially relevant, like the Galaxy S2, so Apple seeks an injunction that covers “any other product not more than colorably different from an Infringing Product as to a feature found to infringe.”
This trial will be separate from another patent infringement lawsuit which is scheduled to be heard on March 31, 2014. Apple scored a win in a damages retrial last month as well, with Samsung being found liable to pay Apple an additional $290 million in damages for infringing on its patents.
