Xiaomi faces ban in India for patent infringements



It looks like Xiaomi’s successful spree in the Indian smartphone market could be drawing to a close now as the company has been ordered by an Indian court to stop importing and selling its smartphones in India. It isn’t clear right now if the ex parte order against the Chinese manufacturer will mean that its retail partner for the Indian market – Flipkart will immediately stop sales of Xiaomi smartphones.

The patents that Xiaomi has been found to infringe are the Standard Essential Patents (SEPs). According to the report published on spicyip, these parents could be the same patents that Micromax, Gionee and Intex have also reportedly infringed and Ericsson India has filed a case against these manufacturers as well in the Delhi High Court. It does seem a bit strange that the Micromax, Gionee and Intex haven’t received an injunction yet when the case against them was filed earlier. The main reasons why the court issues the injunction against Xiaomi before the other manufacturers is said to be due to the fact that Xiaomi did not respond to Ericsson India’s communications regarding the patent infringement issue. This indifference is reportedly the main reason behind the injunction.

The Court has appointed officials to visit Xiaomi India offices to make sure that the order of the court is respected and that the company doesn’t continue to sell its smartphones that infringe on the patents in question. Customs officials have been asked to block all imports by Xiaomi to India under Indian laws.

Xiaomi India has not decided its stance yet and claims that they haven’t received any orders from court. However, Xiaomi India head Manu Jain did say that the company’s legal team was handling the issue and they hope to sort out the issue with Ericsson. India has become an important market for Xiaomi, just 6 months after it entered the market with its Mi3 smartphone. The company had recently launched the Redmi Note and Redmi Note 4G models in India. But with this injunction, it isn’t clear if customers in India will be able to purchase Xiaomi handsets in the near future.
